Welcome to this website (hereinafter referred to as “this Website”), which is owned and operated by GoodARCH Technology Sdn. Bhd. (a company registered in Malaysia) (hereinafter referred to as “the Company”). Please read these Terms of Use carefully before using any services provided by this Website. Your continued access or use of this Website indicates that you have read, understood, and agreed to be bound by these terms.

Application and Modification
  1. These Terms of Use apply to all users who access, browse, or use this Website.
  2. The Company reserves the right to modify or update these terms at any time. Any modifications shall take effect immediately upon being posted on this Website. A user’s continued use of this Website after such modifications constitutes acceptance of the updated terms.
  1. The services provided by this Website include online information, product descriptions, electronic transactions, customer support, etc.
  2. The Company reserves the right to add, adjust, or terminate some or all of the services without prior notice, based on actual circumstances.

If a user is a minor under the age of 18, they should use this Website with the consent and supervision of a parent or guardian.

Data Collection and Use: Users agree that the Company may collect and use personal data in a lawful, reasonable, and necessary manner in accordance with the PDPA.


Data Rights:
Users have the following rights:

  1. The right to access and correct their personal data.
  2. The right to withdraw consent.
  3. The right to data portability (effective from June 2025): Where technically feasible, a user may request the Company to transfer their personal data to another data controller.

 

Data Breach Notification: In the event of a personal data breach, the Company will, as required by the PDPA:

  1. Notify the Commissioner of Personal Data Protection as soon as possible.
  2. Notify affected users “without undue delay” if the breach is likely to cause significant harm.


Cross-Border Data Transfer:

  1. The Company will only conduct cross-border data transfers if the receiving country has an equivalent or adequate level of data protection, or if the transfer meets a lawful exception stipulated in the PDPA (such as user consent, contract performance, etc.).
  2. The Company will regularly conduct a Transfer Impact Assessment (TIA) and review it at least every three years.

 

Data Protection Officer (DPO): If the Company meets the thresholds required by the PDPA, it shall legally appoint a qualified Data Protection Officer and complete the registration.

The Company complies with the relevant provisions of the E-Commerce Act 2006 and the Consumer Protection Act 1999, and shall provide the following information as required by law:

  • The full name and registration number of the company.
  • The company’s contact information (including email and phone number).
  • A description of the main characteristics of the goods or services.
  • The total price of the goods or services, including taxes and shipping fees.
  • Payment methods and terms.
  • Estimated time for delivery or performance.
  • Channels for user complaints or after-sales service.


Electronic signatures and electronic contracts shall have legal validity in accordance with the ECA when they meet the legal requirements.

  1. All content on this Website, including but not limited to text, images, audio, video, software, and trademarks, is protected by the Malaysian Copyright Act 1987 and related intellectual property laws.
  2. Users may not copy, modify, distribute, or use it for commercial purposes without the written permission of the Company.
  1. This Website may contain third-party advertisements or links. The relevant content is the responsibility of the third party, and the Company is not responsible for its authenticity, legality, or completeness.
  2. Any transactions and disputes between the user and a third party shall be resolved by the parties themselves.

The Company reserves the right to suspend or terminate the services of this Website without liability for compensation in the following circumstances:

  • System maintenance, upgrades, or adjustments.
  • Due to force majeure (natural disasters, government actions, network failures, etc.).
  • The user violates laws, regulations, or the contents of these terms.
  1. The Company does not guarantee that the services of this Website will be completely error-free, uninterrupted, or will meet all user needs.
  2. The user shall bear all risks arising from the use of this Website’s data or transactions with third parties.
  1. These Terms of Use shall be governed by and construed in accordance with Malaysian law.
  2. Any disputes arising from these terms shall first be resolved through friendly negotiation between the parties. If negotiation fails, the parties agree to submit to the exclusive jurisdiction of the Malaysian courts.
  1. These terms constitute the entire agreement between the user and the Company.
  2. If any part of these terms is deemed invalid or unenforceable, the remaining parts shall remain in effect.
  3. The headings of the terms are for convenience of reading only and do not affect the interpretation of the terms.
